Man who was on his phone when he hit, killed cyclist speaks out

“I made a mistake that day I could never take back.”

Just a glance at your phone may change lives forever. This is the story of Chris Weber, a man sentenced for the death of Andrea Boeve, mother of two, who was out for a bike ride and never came home.

At night, Chris Weber relives the crash he caused but didn’t see.

A year ago, driving his pickup in rural Rock County, he decided to call his bank to make a loan payment. He looked down at his cellphone. Then he heard a thud.

He had hit Andrea Boeve, 33, who was biking alongside Hwy. 270, her two daughters in a carrier behind her. He ran to her, performing CPR, but Boeve died at the side of the road.

“My heart dropped,” Weber told reporters at a news conference. “I knew it was my fault.”

This powerful video shows the consequences of glancing at your phone while driving.

Be safe. Be aware. Our thoughts and prayers go out to the Andrea’s family.

The conviction is in, Doctor sentenced to five years in prison for assault on cyclists.

The California physician, convicted of assaulting a pair of cyclists with his car, was sentenced to five years in prison at the close of a hearing in Los Angeles Superior Court on Friday morning.

Sixty-year-old Christopher Thomas Thompson, found guilty of six felonies and a misdemeanor, has been in custody since his conviction in November. Following an emotional two-hour hearing Superior Court Judge Scott T. Millington sentenced Thompson to two years on the charge of assaulting cyclists Ron Peterson and Christian Stoehr with a deadly weapon and added a three-year enhancement because Peterson suffered serious bodily harm. The remaining lesser charges also carry prison time, but those sentences will be served concurrently with Thompson’s five-year sentence. The judge also ordered that Thompson be stripped of his driver’s license for life.

Prosecutors had asked that Thompson be sentenced to eight years for crimes mostly relating to a July 4, 2008 incident in which he abruptly stopped his car in front of the two riders descending Mandeville Canyon road, near Los Angeles. Thompson was also convicted of misdemeanor charges relating to a similar incident that occurred months earlier, but did not result in injuries.

Expressed remorse
Thompson took the stand Friday and accepted full responsibility for his actions, expressed remorse and apologized to Peterson, Patrick Watson and Josh Crosby, who were in attendance on Friday. Stoehr did not appear in court on Friday.

“I would like to apologize deeply, profoundly from the bottom of my heart,” he told the three cyclists.

Thompson spent much of the hearing in tears, as the three cyclists testified about the incidents that ultimately led to Thompson’s conviction. The riders asked that a severe sentence be imposed in the case.

While his client appeared contrite on the stand, Thompson’s attorney, Peter Swarth, continued to maintain that he had never intended to hurt anyone. Thompson dropped his head into his hands and wept when Millington imposed sentence in the case.

In November, Thompson was convicted of assaulting Peterson and Stoehr on the morning of July 4th after a brief exchange of words, in which he demanded that the two – moving down the hill at nearly the speed limit – ride in single file. Thompson then passed the two cyclists and slammed on his brakes, causing the riders to crash into the rear his car.

Stoehr hit the back of the car and vaulted into oncoming traffic lane. His injuries included a grade-three shoulder separation and road rash. Peterson went through the rear window of the car; the impact broke his nose, nearly severing it from his face, and shattered several of his teeth. More than 90 stitches were required to reattach his nose.

Thompson also told the first police officer on the scene that he intentionally hit his brakes in order to “teach (the two riders) a lesson.”

John Kerry Suffers Broken Leg in Bike Accident in France

Secretary of State John Kerry suffered a broken leg in a bike accident in France early Sunday.  The cycling accident occurred near Scionzier, France, about 25 miles from Geneva, where Kerry had been holding nuclear talks with Iran’s foreign minister, Javad Zarif.

John Kerry’s U.S. surgeon is on his way to Switzerland to inspect the injury that the secretary of state sustained in this cycling accident. Dr. Dennis Burke of Massachusetts General Hospital performed a past hip surgery on Kerry. He will join up with the secretary in Geneva and accompany him back to the United States, a senior State Department official said late Sunday.

State Department spokesman John Kirby said Kerry had suffered a broken femur but was expected to make a full recovery. Kerry had planned to fly back Sunday evening to the U.S., but doctors decided it was “sensible” for him to remain in the hospital for observation overnight and fly home Monday, Kirby said.

He said Kerry never lost consciousness and was grateful to the French and Swiss doctors and nurses who assisted him. Paramedics and a physician were in Kerry’s motorcade at the time of the accident, Kirby said.

Auto accidents are one of the most common reasons for the death and injuries of Americans. According to the National Highway Traffic Safety Administration (NHTSA), there have been 2,791 fatalities caused by traffic accidents in 2011. This means a 71-fatality increase from 2010. While this may be a relatively low increase, a car accident lawyer points out that this is the first time that there is an increase in vehicle crash fatalities recorded since 2007.

More than the loss of lives, automotive crashes have caused millions of dollars of damage to property. This is why a California auto accident lawyer wants to remind everyone that anybody can file a personal injury claim after falling victim for such mishaps. However, to successfully win your claims you have to present enough and strong pieces of evidence to back up your claim when you file for one. But how do you prepare for the filing of your complaint?

To increase your chances of winning your claim, your first actions after the accident happened will be critical. So how can you ensure your victory should you file a claim?

  • Call the police immediately.

Pedestrian versus auto collision

October 31, 2013 at approximately 8:21AM

Intersection of Miller Avenue and Magnolia Avenue, in the City of South San Francisco, CA

Narciso and Alexander, a six year old child, were standing on the southeast corner of the intersection of Miller Avenue and Magnolia Avenue. They were on their way to Alexander’s elementary school. The defendant was traveling eastbound on Miller Avenue in a red Pontiac Grand AM.  Suddenly,  the Grand AM decided to proceed across the intersection. The car was halfway across the intersection when he noticed our Narciso and Alexander crossing the street. The driver was unable to react in time, and the front left of his vehicle struck both Narciso and Alexander along the left side of their bodies. Upon impact, Narciso put his left hand on the center hood of the vehicle and rolled over the hood towards the driver side of the vehicle, thereafter falling from the hood to the ground. They were hit with the front left side of the vehicle.

Violation of CVC § 22350 which states…“No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

The injuries Narciso sustained were so severe that the police believed they were responding to a pending fatal accident. Narciso was bleeding profusely from his head and eventually needed twenty four sutures to close the wound. Alexander had to be physically restrained by witnesses because he believed he was watching his father die, and was completely hysterical. Alexander has needed psychiatric evaluation as a result of this incident and will suffer from the trauma for an indeterminable amount of years.

As direct result of this drivers negligence and disregard for the safety of other citizens, Narciso and Alexander were the victims of a serious vehicle collision. Sariol Legal Center took this case right away, winning a settlement for Narciso.  Both still relive the events of this accident and are constantly anxious, nervous, and scared any time they are in or around traffic.

After being rejected by 7 law firms, SLC closed out the case the policy limit of 25 thousand dollars. (The maximum amount for bodily injury in the Defendants Car insurance policy).

California Labor Law to Extend Protection to Undocumented Workers

Supreme Court Health CareCalifornia – Governor Jerry Brown has signed new California labor laws that would protect undocumented workers in the state.

In the newly-signed law called The Trust Act, the local police would be limited from cooperating with the Department of Homeland Security’s Secure Communities, a federal agency that generally asks police to check on arrestee’s immigration status and hold them if they are found undocumented.

Based on statistics, the agency has already deported approximately 10,000 undocumented immigrants working in California, including those without serious criminal records.

Thus, the new law will now require illegal immigrants to be charged with or convicted of serious offense before being held for possible deportation by the federal agency.

In addition, two other bills have been recently approved by Gov. Brown.

In the first bill, its author Assemblyman Roger Hernandez creates a category of unfair immigration-related retaliation with a specific penalty.

In the second bill, its author Senate Leader Darrell Steinberg extends the legislation to lawyers who participate in intimidating workers by their immigration status to prevent them from talking about their employers’ labor violations.

Several business groups on the other hand oppose the new legislations, arguing that employers should not be penalized for the actions of their harsh supervisors and managers.
